How to renew of a trademark in Bangladesh?

A trademark can be renewed in Bangladesh from time to time for an unlimited period upon payment of the renewal fees, failing which the mark becomes liable to be removed from the Register on account of non-renewal. Each renewal term is for a period of 10 years.

The procedure for filing for a renewal of a trademark in Bangladesh is as follows:

BEFORE THE EXPIRY
Request to renew a trademark in Bangladesh can be filed within 6 months BEFORE THE EXPIRY of the registration/ renewal term if accompanied by the requisite renewal fees on the prescribed form.

AFTER THE EXPIRY
Request to renew a trademark in Bangladesh can be filed within 6 months AFTER THE EXPIRY of the registration/ renewal term if accompanied by the requisite renewal fees on the prescribed form.

A Certificate of Renewal is issued by the Registrar as evidence of payment of the renewal fee due at that period. Clients are advised that the renewal fee due on a mark cannot be paid until the mark is registered. Clients are therefore advised that they need not worry about the renewal fee until the mark has been registered.

Requirement for Renewal of trademarks in Bangladesh
(1) Registration Number and Class of the Trademark
(2) Copy of the last renewal or registration certificate
(3) POA: Notarization or legalization does not require. Scanned copy is sufficient.



Restoration of Trademarks in Bangladesh

If a trademark has been removed from the Register on grounds of non-renewal then the same can be restored by filing an application in the prescribed form for restoration of the mark within 1 year from the expiration of the last registration of the trademark.

Relevant Laws and Acts for the trademark renewal in Bangladesh

Section 22. Duration, renewal and restoration of registration.
(1) The registration of a trademark shall be for a period of seven years, but may be renewed from time to time in accordance with the provisions of this section.

(2) The Registrar shall, on application made by the registered proprietor of a trademark in the prescribed manner and within the
prescribed period, renew the registration of the trademark for a period of 10(ten) years from the date of expiration of the original registration or as the case may be, of the last renewal of registration. 

(3) At the prescribed time be fore the expiration of the last registration of a trademark, the Registrar shall send notice in the
prescribed manner to the registered proprietor of the date of expiration and the conditions as to payment of fees and otherwise
upon which a renewal of registration may be obtained, and if at the expiration of the time prescribed in that behalf those conditions have not been duly complied with the Registrar may remove the trademark from the Register.

(4) Where a trademark has been removed from the Register for non-payment of the prescribed fee, the Registrar may, within 1(one) year from the expiration of the last registration of the trademarks, on receipt of an application in the prescribed from, if satisfied that it is just so to do, restore the trademark to the Register and renew the registration of the trademark either generally or subject to such conditions or limitations as he thinks fit to impose, for a period of 10(ten) years from the expiration of the last registration. 


Section 23. Effect of removal from registration for failure to pay fee for renewal.
Where a trademark has been removed from the Register for failure to pay the fee for renewal, it shall nevertheless, for
the purpose of any application for the registration of another trademark during 1(one) year next after the date of the removal, be
deemed to be a trademark already on the Register, unless the Tribunal is satisfied?

(a) that there has been no bona fide trade use of the trademark which has been removed during the 2(two) years immediately preceding its removal; and

(b) that no deception or confusion would be likely to arise from the use of the trademark which is the subject of the application for registration by reason of any previous use of the trademark which has been removed.
